Frequently Asked Questions

What is Debt Relief?

Debt Relief allows you to pay a lump sum that is typically less than the amount you owe to resolve or settle your debt. We reduce your debt by negotiating settlements with your creditors or debt collectors.

How Debt Relief Works

A typical debt resolution program lasts 24-48 months and payback between 50-60% of the outstanding debt enrolled. With our negotiation, we will get your creditors to agree for a lump-sum payment that’s less than the amount you owe.

We contact your creditors on your behalf so that we can negotiate a better payment plan or settle or reduce your debt and inform the creditor about your dire financial situation. Once the creditor receives our letter, including the “Limited Power of Attorney” which gives us permission to discuss your account the collection calls will stop and the creditors will only deal with us.

Who is eligible for a debt relief?

Those who have fallen behind or about to fall behind on their payments to creditors because of financial hardships are qualified for a debt settlement. We deal with any account delinquency stage and even if you have been served a summons and sued by a creditor. Our in house attorneys will help with all the documents that are necessary to defend your case and avoid a creditor judgment.

How does this affect my credit?

Your credit will be negatively affected by debt negotiation for a short period of time and can be improved once you become debt-free. Your credit score will already be affected if you are already behind your bills.

Is this a debt consolidation loan?

We can consolidate your debt into one low monthly payment. We do not offer debt consolidation loans.

Can I negotiate with my creditors on my own?

You are allowed to negotiate with your creditors on your own. Most people do not want to speak to their creditors which is why they trust us to negotiate with them.

How long will it take to get out of debt?

Most program length varies but it is usually between 15-24 months. It all depends on how fast you can save up for the settlement offers.

Will I get sued by my creditors?

There is a possibility that a creditor can sue but we aim to obtain a settlement as soon as possible to avoid any lawsuit.

Can I continue to use my credit cards?

Creditors will close your accounts after you have missed a few payments.

Will I have to pay taxes on the forgiven debt?

“A taxpayer is insolvent when his or her total liabilities exceed his or her total assets. The forgiven debt may be excluded as income under the ‘insolvency’ exclusion. Normally, a taxpayer is not required to include forgiven debts in income to the extent that the taxpayer is insolvent.” – IRS.gov

How is debt negotiation different from bankruptcy?

Bankruptcy is the last option you will have if you need to protect any assets. It will remain on your credit report for 10 years and you can be denied employment, state licenses, insurance, and tenancy of an apartment. You will be denied any type of credit. It will also be difficult to qualify for Chapter 7, which liquidates assets to eliminate your debt. Under Chapter 13, you will still have to pay a percentage of your debt while going through bankruptcy.
